أولاً: تعريفات المصطلحات

"مندوب التوصيل" هو كل شخص يقوم بالتوصيل من المتاجر أو توصيل الطرد أو توصيل الإرساليات بين المدن بناءً على طلب العميل.
"العميل" يشير إلى كل شخص يطلب من المندوب خدمات التوصيل أو يطلب من التطبيق خدمات بطاقات الشحن.
"بطاقات الشحن" تشير إلى خدمات شحن الرصيد المتاحة عبر التطبيق التي عن طريقها يقوم العميل باختيار بطاقة الشحن المناسبة له ومن ثم إرسال رسالة برقم بطاقة لشحن رصيده آليًا ودفع مقابلها إلكترونيًا.
"السياسة" أو "سياسة الخصوصية" تشير إلى هذه الوثيقة وما تتضمنه من شروط وأحكام.
"البيانات" تشير إلى البيانات الشخصية وبيانات الاستخدام الخاصة بالمستخدم.
"البيانات الشخصية" تشير إلى كافة البيانات التعريفية الخاصة بالمستخدم، كالاسم وتاريخ الميلاد والجنسية والعنوان والبريد الالكتروني ورقم الجوال والحساب البنكي وغيرها من البيانات المتعلقة بالمستخدم.
"بيانات الاستخدام" تشير إلى كافة البيانات غير الشخصية الخاصة باستخدامك لشبكة الانترنت، كتلك المتعلقة بالحاسب الآلي الخاص بك أو بهاتفك الجوال أو بنشاطاتك أو معاملاتك عبر التطبيق.
ثانيًا: البيانات التي نجمعها عنك
قد نقوم بجمع واستخدام ومعالجة البيانات التالية عنك:
(1) البيانات التي تقدمها لنا عند قيامك بالتسجيل عبر التطبيق، ويشمل ذلك على سبيل المثال لا الحصر الاسم ورقم الجوال والبريد الالكتروني وغيرها من البيانات.
(2) البيانات التي قد تزودنا بها أثناء تقديم الخدمات أو في أي وقت من الأوقات، والتي تشمل على سبيل المثال لا الحصر الجنسية والعنوان ورقم الحساب البنكي أو رقم البطاقة الائتمانية أو غيرها من البيانات التي قد نطلبها منك، أو بيانات موقعك وتشغيل تقنية GPS.

(7) البيانات التي تقدمها لنا عند حدوث مشكلة متعلقة بعملية الدفع الالكتروني للمبالغ المستحقة عليك، أو العمولة المستحقة لنا.

(6) لتلقي الأسئلة والشكاوى والاستفسارات منك، والرد عليها.
(7) لتلقي تعليقاتك وتقييمك للخدمة التي تلقيتها من خلال تطبيقنا، والرد عليها.
(8) لمعالجة إجاباتك على الاستبيانات المطروحة عبر التطبيق والتي شاركت في الإجابة عليها.
(9) لتزويدك بالمعلومات عن الخدمات وبطاقات الشحن التي تطلبها عبر تطبيقنا.
(10) لتزويدك بالمعلومات عن الخدمات وبطاقات الشحن التي نعتقد أنها تثير اهتمامك بما في ذلك العروض الخاصة بنا.
(11) لأغراض العمل الداخلية مثل تحسين خدماتنا.
(12) لتخصيص المحتوى والتوصيات والإعلانات التي نقدمها نحن والأطراف الثالثة لك، سواء على الخدمات أو في أي مكان آخر على شبكة الانترنت.

(2) يتعهد التطبيق بعدم التعامل على بياناتك الشخصية لأغراض غير مصرح أو مسموح بها بمقابل أو بدون مقابل مع أي جهة أخرى إلا إذا كان ذلك مطلوبًا منا أو مصرحًا به بموجب الأنظمة والتعليمات ذات العلاقة، أو بموافقة كتابية مسبقة من المستخدم الذي تتعلق به المعلومات.
(3) يتعهد التطبيق بالحفاظ على السجلات التي تحتوي على البيانات الشخصية للمستخدم أو أي سجلات للاتصالات الالكترونية، تكون في عهدتنا أو تحت سيطرتنا أو مع وكلائنا أو منسوبينا.
(4) يتعهد التطبيق باتخاذ الخطوات المعقولة، لضمان أن البيانات الشخصية للمستخدم، والسجلات ذات الصلة، محمية بطريقة أمنية تناسب أهميتها.
(5) نتعهد بحماية خصوصيتك في جميع الأوقات، وأننا لن نبيع أبدًا بياناتك الشخصية، أو نسمح بتداولها مع الغير.
سادسًا: مشاركة بياناتك

سابعًا: التزامات العميل ومندوب التوصيل
(1) يلتزم أطراف هذه الاتفاقية بالمحافظة على سرية وخصوصية بياناتهم الشخصية، ويقرون وعلى مسئوليتهم الشخصية بأن إفصاح أيًا منهم عن البيانات الشخصية للطرف الآخر يكون على مسئوليته دون أي تدخل منا، ودون أي مسئولية علينا.
(2) يلتزم الأطراف بعدم الإفصاح عن أي بيانات شخصية خلال استخدام خاصية الرسائل داخل التطبيق، وأنهم مسئولون مسئولية شخصية عن أي إفصاح من هذا النوع.
(3) يتعهد الأطراف بالمحافظة على أسرار التطبيق، ويُسأل كلاً منهم في مواجهتنا عن أي إخلال بسرية التطبيق وعملياته.
(4) تلتزم بالامتناع عن الإفصاح عن أية بيانات متعلقة بتشغيل التطبيق إلى الغير سواء بمقابل أو بدون مقابل.
(5) تلتزم بالمحافظة على سرية كافة البيانات المتعلقة بتفاصيل المعاملات عبر التطبيق، وعدم استخدامها بأي شكل من الأشكال، وتعد مسئولاً مسئولية عقدية وقانونية عن أي استخدام غير مشروع أو غير مصرح به لهذه البيانات.
(6) أنت تقر بتجنب إتباع أي وسيلة من شأنها أن تساعد على جمع البيانات عن المستخدمين الآخرين، بما في ذلك البريد الالكتروني وأرقام الجوال ووسائل الاتصال الأخرى الخاصة بهم.

(8) لمعالجة إجاباتك على الاستبيانات المطروحة عبر التطبيق والتي شاركت في الإجابة عليها.
(9) لتزويدك بالمعلومات عن الخدمات وبطاقات الشحن التي تطلبها عبر تطبيقنا.
(10) لتزويدك بالمعلومات عن الخدمات وبطاقات الشحن التي نعتقد أنها تثير اهتمامك بما في ذلك العروض الخاصة بنا.
(11) لأغراض العمل الداخلية مثل تحسين خدماتنا.

Fifth: Application Guarantees to Protect User Data
(1) The application undertakes to retain your personal or banking data for the duration required by the nature of the transaction you make through the application.
(2) The application undertakes not to deal with your personal data for unauthorized or prohibited purposes, with or without consideration, with any other party, except if required by us or authorized by us under the relevant regulations and instructions, or with the prior written consent of the user to whom the information relates.
(3) The application undertakes to maintain records containing the user's personal data or any records of electronic communications, whether in our custody or under our control or with our agents or affiliates.
(4) The application undertakes to take reasonable steps to ensure that the user's personal data and related records are securely protected in a manner appropriate to their importance.
